Terms of Service
Please read these terms carefully before using our monitoring platform.
1. Operator & Agreement
These Terms of Service govern your use of the CertFleet platform, including the public website (certfleet.net), the public SSL checker, and the CertFleet web application. By creating an account or accessing the service, you agree to be bound by these terms.
The service is operated and published by:
MCS, registered under SIREN 106 942 600 (R.C.S. Nantes), EU identification number FR4401.106942600
5Q Avenue des Naudières
44800 Saint-Herblain
France
2. Eligibility & Accounts
You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account. You are responsible for safeguarding your login credentials (passwords, social OAuth login sessions) and for all activities that occur under your account. You agree to provide accurate, complete, and current registration information.
3. Subscription Plans, Free Trial, and Recurring Billing
- Pricing: Subscription fees and features for each plan are detailed on our pricing page (/pricing). All fees are billed in USD or EUR, as indicated at checkout.
- Payment Processing: All transactions are processed securely through our third-party payment provider, Stripe. We do not store or process your raw credit card information.
- Automatic Renewal: Paid plans are billed in advance on a recurring monthly or annual basis, depending on your selection. Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date.
- Free Trials: Any free trial period offered automatically transitions to a paid subscription at the end of the trial period. If you do not wish to be billed, you must cancel your subscription through the customer portal before the free trial expires.
4. Cancellation & Refund Policy
You may cancel your subscription at any time directly through the customer dashboard or via the Stripe billing portal linked within your settings. Upon cancellation, your subscription will remain active and you will continue to have access to paid features until the end of your current pre-paid billing cycle.
No Refunds: To the maximum extent permitted by applicable law, we do not offer partial refunds, credits, or pro-rated adjustments for unused portions of a subscription month or year, or for periods of inactivity.
5. Permitted Use & Monitoring Ethics
CertFleet is designed for passive TLS, DNS, and uptime checks. You agree to use the service in compliance with all applicable laws and the following ethical guidelines:
- Ownership and Consent: You must only configure monitors (hostnames, ports, and URLs) that you own, operate, or are explicitly authorized by the owner to monitor.
- No Vulnerability Probing: CertFleet only reads public certificate metadata and passive network state. You must not use the tool to perform active vulnerability scanning, port scanning, security exploitation, or distributed denial-of-service (DDoS) simulations on third-party infrastructures.
- System Integrity: You must not attempt to disrupt or bypass the rate limits, security parameters, or operational integrity of the CertFleet platform. Abuse of the public free tools or api limits will result in an immediate IP and account ban.
6. Disclaimer of Warranties & Limitation of Liability
The CertFleet service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- No Guarantee of 100% Alert Delivery: CertFleet scheduled checks depend on passive internet routes, DNS servers, and third-party alert providers (such as Google Cloud, Resend for email, Slack, and SMS gateways). While we strive for maximum accuracy, we cannot guarantee that you will receive 100% of alerts or that monitors will never experience false positives or false negatives.
- Limitation of Liability: In no event shall MCS, CertFleet, or its directors and employees be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of business, profits, revenue, or data) arising from service interruptions, expired TLS certificates, website downtime, or missed notifications, even if advised of the possibility of such damages.
7. Termination
We reserve the right to suspend or terminate your account and restrict access to the service at our sole discretion, without prior notice, if we believe you are violating these terms, engaging in unauthorized network scanning, or causing harm to other users or our infrastructure.
8. Governing Law & Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of France. Any dispute, controversy, or claim arising out of or in connection with these Terms of Service or your use of the CertFleet platform shall be submitted to the exclusive jurisdiction of the competent courts of Nantes, France.
9. Changes to These Terms
We may update these terms from time to time to reflect operational or legal adjustments. When updates are made, we will post the updated terms on this page and revise the "Last updated" date. Your continued use of the service after any such changes constitutes your acceptance of the new terms.
This document governs the relationship between you and MCS regarding the CertFleet platform.
